It often happens that students take admission in a college and then later withdraw to join a different college. Reasons can be many for this step. Now, from the students’ and parents’ side, there is usually a lack of clarity or knowledge of what needs to be done, and they do worry about whether they will get their money back. Questions such as a refund of the fee or holding of the certificate by the college authorities in case the student joins another college are plenty. This article aims to help students and parents to understand what can be done in such situations.

The article takes into account the UGC fee refund policy of 2026 and how to act against the illegal holding back of the certificate by the college. Let us understand what steps a student can take in case any of these two incidents take place with them?

The law in India is clear- Students have the right to get their fees back based on the fee refund policies, and institutions can not hold back the original certificates of students.

This handbook is a legal document as per AICTE, ensuring that a massive fee refund policy exists to help students get their fees back. This fee refund policy states that:
If a student withdraws before the start of the course, then the student will get a complete refund of the fee submitted, excluding the small amount of processing fee only, which is less than Rs. 1000/.
Even if the course has started, the student can get a full refund, provided that their vacated seat is filled by another student by the last date of admission.

The image given above shows a case in which students had completed their integrated law course from Mahatma Gandhi Law College, Hyderbad and were the beneficiaries of the government fee reimbursement scheme. The college withheld all original certificates and refused to release them because the Telangana Government had not released the pending fee reimbursement amounts. As a result, students had to face the risk of missing the LLM admission verification deadline.

In this case, the college has withheld the following documents of the students: SSC (10th Standard) Certificate, Intermediate Certificate, LLB Marks Memos, Transfer Certificate, and Bonafide Certificate.
Without these documents, students can not apply for jobs, can not pursue further studies, and can not apply for a competitive exam

Telangana High Court’s Position is also stating that “We are not expressing any opinion on the right of the College to recover amounts... but we hold that withholding her original academic qualification certificates, is IMPERMISSIBLE IN LAW."
