Coaching institutes in India, in places such as Kota, quite often market themselves as hubs of toppers through topper and All India Rank promotions to attract more students. Each year, once the JEE and NEET results are announced, coaching institutes go into overdrive by advertising “their” toppers' accomplishments. This is done through various media such as social media, billboards and YouTube.

    The Motion Kota Controversy

There have been allegations against the Motion Education coaching institute. This includes use of misleading advertisement claims in relation to the success rate of students in entrance examinations such as JEE and NEET. According to the reports, CCPA conducted an inquiry on the promotional campaigns and came across several irregularities. The primary one being how rankers and results were falsely advertised publicly. This has raised serious questions regarding the credibility of such coaching advertisements and the impact on students and parents.

    Details of the CCPA Investigation:

    • The Chief Commissioner of CCPA (Mrs. Nidhi Khare) and Commissioner (Mr. Anupam Mishra) carried out the investigation.

    Ten Major Issues Identified:

    Issue Number

    Description

    1

Inflated success rates with no supporting evidence.

    2

Claimed free course students as paid students to boost the success rate.

    3

Deliberate hiding of which courses toppers took, misleading that all succeeded via paid full-time classroom/residential courses.

    4

A student (Maulik Jain, AIR 52 JEE Advanced 2025) enrolled 9 days after the exam, falsely presented as a successful student.

    5

Another student (Arush Anand, AIR 64) enrolled on the exact day results were declared, falsely implying that coaching helped.

    6

Use of photos without consent, including cases where the student’s face was combined with another body image in ads.

    7

Featuring non-students in advertisements who only submitted details for awards or free tests but were not enrolled or taught.

    8

Failure to disclose course type, fee structure, and duration in ads, which misleads consumers.

    9

Excuses for lack of disclosures (such as “not enough space in full-page ads”) were rejected by the CCPA.

    10

General lack of transparency and honesty, amounting to consumer fraud and student deception.

This table highlights the 10 major issues that were identified in the CCPA investigation. Check out the above table more.

    Concerns Raised by the Case

    • The controversy related to Motion Kota has also shed light on the common marketing tactics generally used by the coaching institutes in India, like many institutes claiming the same rankings, a lack of clear disclosures, and selective result highlighting.

    • Coaching institutes often make false claims, impacting students' and parents' dreams as they are paying substantial fees based on the inaccurate information.

    • The penalty of ₹10 Lakh was imposed on Motion Education Private Limited, which, according to the presenter, is less compared to the extent of the fraud and its impact on students.

    • Students who were influenced by such advertisements should have a full fee refund, as was done in previous cases in which SEBI took such steps.

    • A strict action should be taken by authorities such as the Ministry of Consumer Affairs, the Ministry of Education, and the Ministry of Home Affairs. This will keep parents and students informed and protected, and also ensure accountability.

Need of Ethical Standards in Coaching Advertisements

Evidence-Based Claim- It should be mandatory for coaching institutes to provide data that can be verified and held the coaching institute accountable.

Consumer Protection in Education: Such advertisements should be transparent, accurate and should be evidence-based in order to keep the students’ trust and their rights safe.

Consent and Privacy: Another important aspect that should be kept in mind is that the use of personal details and photographs of students, especially minors, without permission is not only illegal but also unethical.

Topper Farming: Promotion of “toppers” as students who belong to their coaching class, even though they have not studied in a paid programme, needs to stop and should be penalised heavily.

This Motion Coaching scam brings to light ethical and trust issues in the coaching industry. Parents and students, too, should make decisions based on concrete evidence, rather than over-the-top claims. At the end, performance in examinations such as JEE and NEET is based on multiple factors, and one must remember that success cannot be guaranteed through advertisements alone.
